Abstract
The work discusses the notion of Pareto efficiency in relation to preferences. It presents Calabresi’s critique of Pareto efficiency in legal contexts, focusing on the unanimity condition that this notion poses; then it develops an argument in favor of Pareto efficiency and redefines some relevant notions, building on Mill’s Harm Principle, distinguishing internal from external preferences, and exploring some limits of the redefined Paretian approach. Finally, it signals prospects for future research.
